Gray Divorce: Special Considerations for Long Island Couples Over 50

Divorce used to be thought of as something that mostly happened to younger couples. That is no longer the case. Across the country, and right here on Long Island, more people are ending long marriages well after their fiftieth birthday. If you are considering a divorce later in life, your situation likely looks very different from a couple divorcing in their thirties, and the legal strategy should reflect that.
The Numbers Behind the Trend
Divorce among people age 50 and older, often called gray divorce, has grown dramatically over the past three decades. According to research from Bowling Green State University’s National Center for Family and Marriage Research, the share of all divorces involving someone 50 or older rose from about 8 percent in 1990 to nearly 40 percent today. Many of these divorces involve marriages that lasted decades, not years.
Why does this matter for Suffolk County couples? Because the issues that dominate a divorce for a couple in their thirties, custody schedules and school arrangements among them, are often far less relevant here. Older couples tend to face a different, and in some ways more complicated, set of financial questions.
Retirement and Long Term Financial Security
For couples over 50, dividing retirement accounts, pensions, and Social Security related benefits often becomes the central issue in the case. There is usually far less time left to rebuild savings before retirement, which raises the stakes considerably. A pension earned over a thirty year career, or a 401k built up over decades, may require careful valuation and a Qualified Domestic Relations Order to divide properly.
Health Coverage and the Marital Home
Health insurance is another concern that younger couples rarely have to think about in the same way. If one spouse has been covered under the other’s employer sponsored plan for years, losing that coverage can be a real financial shock. Housing decisions can also be more complicated later in life. Selling a longtime family home might make financial sense, but it carries emotional weight that should not be brushed aside during negotiations.
Adult Children and Family Dynamics
Even though custody is usually not an issue, adult children often still play a meaningful role in a gray divorce. They may have opinions about the outcome, concerns about aging parents living alone, or questions about inheritance down the road. A thoughtful legal strategy accounts for these family dynamics, even though a court will not decide them directly.
